Terms of Service

1. Acceptance of Terms
By engaging with East and West Health Coaching services (“Services”), operated under the trading name Flowing Qi TCM by Mat Gonzalez, including but not limited to filling out forms, scheduling calls, making payments, or attending coaching sessions, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Services.

2. Description of Services
East and West Health Coaching, under Flowing Qi TCM, operated by Mat Gonzalez, offers personalized health and wellness coaching sessions via Zoom, blending Western medical insights, Traditional Chinese Medicine (TCM) principles, and martial arts-inspired strategies. Services include:

  • Single 60-minute sessions ($90 USD).

  • 5-session bundle ($360 USD, 20% discount).
    Sessions are booked via Calendly, paid through Stripe, and delivered remotely. A 30-minute qualifying call is offered to assess fit.

3. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. By engaging, you confirm you meet these requirements.

4. Payment Terms

  • Payments are processed via Stripe in USD ($90 single session, $360 5-session bundle).

  • Full payment is required before booking coaching sessions. Single sessions are booked immediately upon payment; bundles require booking via a separate link post-payment.

  • All sales are final, except as required by law. Refunds may be issued within 24 hours of payment at our sole discretion, minus any Stripe fees and applicable fines (see Cancellation Policy).

  • Australian clients: Under Australian Consumer Law, you may be entitled to a refund for services not delivered as described or unfit for purpose. Contact us within 7 days to discuss.

5. Cancellation Policy

  • Clients must cancel or reschedule sessions (30-minute qualifying calls or 60-minute coaching sessions) at least 24 hours before the scheduled time via Calendly or WhatsApp.

  • No-shows or cancellations within 24 hours incur a $10 USD fine, deducted from any refund (if applicable) or charged separately via Stripe for bundle clients. For bundle clients, missed sessions count toward the 5-session total.

  • Exceptions may be considered for emergencies at our discretion, subject to applicable laws (e.g., Australian Consumer Law fairness requirements).

  • Flowing Qi TCM reserves the right to cancel or reschedule sessions with notice. If we cancel due to our own circumstances (excluding outages), you may choose a rescheduled session or a refund. For outages, see Power and Internet Outage Policy.

6. Power and Internet Outage Policy

  • If Flowing Qi TCM (Mat Gonzalez) is unable to conduct a scheduled session (qualifying or coaching) due to a power or internet outage, clients will receive a 20% off coupon code for their next session, which is non-transferable.

  • The coupon applies to one 60-minute session ($18 discount, new price $72) or one session within a bundle (pro-rated, ~$14.40 discount). The missed session will be rescheduled via Calendly at no additional cost.

  • Clients will be notified of outages and provided the coupon code via WhatsApp or email within 24 hours. This policy applies only to outages on our end, not client-side issues. Client no-shows or cancellations follow the Cancellation Policy.

7. Client Responsibilities

  • Provide accurate, complete information in the Google Form and during sessions.

  • Inform us of any health conditions or changes that may affect coaching.

  • Follow session guidelines (e.g., attend Zoom calls on time with a stable internet connection).

  • Coaching is not a substitute for medical advice; consult a licensed healthcare provider for medical needs.

8. Limitations of Services

  • The Services are for wellness coaching only, not medical diagnosis, treatment, or therapy.

  • While Mat Gonzalez, operating as Flowing Qi TCM, is a medical doctor, no doctor-patient relationship is formed. Coaching is provided based on general knowledge and TCM principles.

  • Results are not guaranteed and depend on your commitment and circumstances.

9. Intellectual Property

  • All materials provided (e.g., action plans, resources) are owned by Flowing Qi TCM. You may use them for personal, non-commercial purposes only.

  • Do not share, reproduce, or distribute materials without written permission.

10. Liability Limitation

  • To the fullest extent permitted by law, Flowing Qi TCM and Mat Gonzalez are not liable for any direct, indirect, incidental, or consequential damages arising from the Services, including health outcomes or reliance on coaching advice.

  • US: Liability is limited as per applicable state and federal laws.

  • Australia: Liability is limited except where non-excludable under Australian Consumer Law (e.g., guarantees of due care and skill).

11. Governing Law

  • US clients: Governed by the laws of Florida, without regard to conflict of law principles.

  • Australian clients: Governed by the laws of the Australian Capital Territory and the Commonwealth of Australia.

  • Disputes will be resolved through negotiation or, if necessary, in the courts of the applicable jurisdiction.

12. Termination

  • We may terminate or suspend Services at our discretion, with notice, for non-compliance with these Terms.

  • You may discontinue Services at any time, subject to the Cancellation Policy and refund terms.

14. Changes to Terms
We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.

Cancellation Policy

  • Requirement: Clients must cancel or reschedule sessions (30-minute qualifying calls or 60-minute coaching sessions) at least 24 hours before the scheduled time via Calendly or WhatsApp.

  • Applicability: If Flowing Qi TCM (Mat Gonzalez) cannot conduct a scheduled session (qualifying or coaching) due to a power or internet outage, clients will receive a 20% off coupon code for their next session, non-transferable.
